1. This is a writ petition against the order dated 20.2.2006 and 21.2.2006 allotting a fair price shop to respondent no. 5.
2. We have heard counsel for the petitioner and standing counsel for the respondents. According to the petitioner this has been done without any resolution of the Gaon Sabha.
3. In the circumstances of the case, the petitioner may file a representation before respondent no. 3. In case the representation is filed, it may be decided by respondent no.3 by a speaking order, if possible, within three months from the date of receipt of the representation. Respondent no. 3 while passing any order will also give opportunity to respondent no. 5. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self-addressed envelope along with his representation. Respondent no. 3 after taking decision will communicate the same to the petitioner.
4. With these observations the writ petition is disposed of.
