Heard the learned counsel for the petitioner.
Petitioner's application in the suit for summoning relevant register from Sub-Registrar's office for the purposes to obtain photographs of signature and thumb impression of the petitioner-plaintiff for its comparison with the specimen thumb impression and signature, was rejected by the trial court and the revision was dismissed by the revisional court as not maintainable.
The learned counsel contends that the defendant No.2/respondent No.4 is said to have obtained a power of attorney from the plaintiff-petitioner on the basis of which he had executed a sale-deed in respect of the disputed property in favour of defendant No.1/respondent No.3. That power of attorney has been challenged in the suit of the petitioner as a forged document. The original power of attorney in spite of the request of the petitioner was not produced by the defendants before the court. The trial court has illegally refused the request of the petitioner for summoning the relevant register from the Sub-Registrar's office.
Issue notice to the respondents No. 3 and 4 returnable within six weeks.
In the meanwhile, the proceedings in the Original Suit No. 167 of 1998 pending in the court of Addl. Civil Judge, Senior Division (Court No.5), Meerut, shall remain suspended.
