Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that according to prosecution version the applicants and two other co-accused persons discharged shots by firearms. Consequently, one Soney Lal received injuries. The medical examination report of Soney Lal shows that he has received 13 injuries in which injuries no. 1 and 2 were on the vital part of bocy, which may be caused by the firearm. There is no explanation of injuries no. 3 4 and 11 which are contusion. None of the injury was found grievous or dangerous to life. The applicants are in jail since 30.12.2005
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and learned A.G.A. and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Rukumpal and Shyam Pal involved in Case Crime No. 603 of 2005, under Sections 307 I.P.C., Police Station Kampil , District Farrukhabad be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
