Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The only allegation against him is that from his possession some stolen articles were recovered. The recovery was not supported by any public witness. The applicant is in jail since 19.1.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Santosh Kumar involved in Case Crime No. 12 of 2006 under Sections 457, 380, and 411 I.P.C. , Police Station Govind Nagar , District Kanpur Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
