Sri H.M. Srivastava, learned counsel for the petitioner submits that an auction for grant of fishery patta was held on 31.1.2004 for which the petitioner was the highest bidder and the papers relating to the approval of the said auction have been sent to the S.D.O., Naugarh, Siddharth Nagar but no order has been passed by the S.D.O. thereupon. The prayer made is that the S.D.O. Naugarh, Siddharth Nagar be directed to pass appropriate orders on the said papers.
Having heard Sri S.K. Yadav holding brief of Sri Anuj Kumar, learned counsel for the Gaon Sabha and the learned standing counsel and without expressing any opinion upon the merits of the petitioner's case the writ petition is disposed of with the direction to the S.D.O., Naugarh, Siddharth Nagar that if the papers relating to grant of approval are pending before him he may examine the matter on merits and pass appropriate order either of approval or disapproval if possible within two months from the date a certified copy of this order is filed by the petitioner
