Heard learned counsel for the petitioner.
Cause shown is sufficient. Restoration application is allowed. Order dated 29.4.2003 dismissing the writ petition in default is set-aside.
Stay order dated 12.10.90 staying eviction of petitioner from the property in dispute in pursuance of order dated 28.7.90 passed by IV A.D.J Saharanpur is revived subject to the condition that with effect from March 2006 onwards, petitioner pays rent to the landlord at the rate of Rs. 550/- per month by 7th of each succeeding month through money order after deduction money order charges. Rent for the month of March 2006 shall be paid by 7.5.2006.
In case of default stay order shall stand automatically vacated. Non-payment of this amount may also be a ground for dismissal of the writ petition.
