Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that in the present case the F.I.R. was lodged on 29.10.2005 at 0.10 a.m. in respect of incident which had occurred in the night of 25/26.4.2005 and the recovery of stolen electric wire have been shown from the possession of the applicants. The applicants is in jail since 13.2.2006. The recovery was not supported by any public witness and it cannot be said that the recovered wire was stolen property.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and learned A.G.A. and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Sunil Nat, Ashok Yadav and Shyambali involved in Case Crime No. 125 of 2005, under Sections 379/411 I.P.C., Police Station Phaphena , District Ballia be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
