Heard learned counsel for the applicants, Sri Ravindra Rai learned counsel for the complainant and learned A.G.A.
According to the prosecution case the applicants have embezzled Rs. 9,50,406/- of the society from 27.7.05 to 30.7.05 while they were posted as officials at the office of Krishak Sewa Sahkari Samiti Ltd. Daurala, Meerut.
The Administrative Committee enquired about the embezzlement and according to the report the entire liability was fixed on the security of the society who had signed on all 36 receipts. The persons who had obtained receipts from the Secretary. In their statement they stated that they paid the money to the Secretary and obtained the receipts from him.
In the circumstances I am of the opinion that the applicants deserve bail.
Let the applicants Mahabir Singh and Devendra Pal Singh involved in Case Crime No. 261 of 2005 under sections 467/468/420/409 I.P.C. P.S. Daurala District Meerut be released on bail on their furnishing a personal bond with two sureties each in the like amount to the satisfaction of Court concerned.
