The petitioners are defendants in the suit in which there is an interim injunction of status quo. In this plaint, the plaintiff has sought the relief that the plaintiff should not be dispossessed forcibly.
The petitioners in this writ petition want that the application for interim injunction should be disposed of within a time frame. Even if the injunction application is rejected, the petitioners, who are defendants, cannot claim that they will dispossess the plaintiff by force. Therefore, the decision of the interim injunction application will not benefit the petitioners in any manner. Thus there is no urgency in the matter.
Order for expediting the hearing before the trial court can be passed only on showing real urgency and cannot be passed on the whims of the litigants.
Writ petition is dismissed as above.
