This petition was filed in the year 2001. Since then, whenever the matter is listed, only illness slips are sent either by the learned counsel for the petitioners or by the learned counsel for the respondents as is evident from the order-sheet dated 10.4.2006, 3.5.2006, 10.5.2006 and 9.10.2006 of the connected petition. The Court accordingly by the order dated 16.10.2006 vacated the interim order. Inspite of vacation of the interim order, illness slip was sent by Sri H.C. Dubey, learned counsel for the respondents. This Court then passed the following order on 1.12.2006 in the connected petition:-
"List the matter in the next cause list peremptorily as Sri H.D. Dubey, learned counsel for the respondents has sent an illness slip and in case any of the counsel sends an illness slip again, it shall not be respected."
Today again an illness slip has been sent by Sri H.C. Dubey, learned counsel for the petitioners. The illness slip cannot be respected and the petition is dismissed in default.
The interim order, if any, stands vacated.
