Learned counsel for the petitioner urged that petitioner along with other chak holders are affected by the impugned order of Deputy Director of Consolidation relating to chak road and the order was passed without giving opportunity of hearing to the affected parties.
Issue notice to Opposite Party Nos. 2 to 9. Petitioner shall take steps to serve opposite party no. 2 within ten days by registered post.
Sri V.K.Singh, learned Counsel has accepted notice on behalf of Gaon Sabha, Opposite Party No. 10 and learned Standing counsel on behalf of Deputy Director of Consolidation, Allahabad, Opposite Party No.1. They pray for and are granted one month's time to file counter-affidavit. Rejoinder- affidavit, if any, may be filed within two weeks next thereafter. List thereafter
In view of the averments made in paragraph 16 of writ petition, re-carvation of new chak-road in pursuance of impugned order dated 19.12.2005 passed by Deputy Director of Consolidation, Allahabad shall remain stayed.
