This writ petition has been filed for a direction upon the respondents U.P. Financial Corporation to execute the sale deed in favour of the petitioner in accordance with law.
The records reveal that an advertisement was issued in the newspaper for purchase of assets of M/s. Ravindra Foam Products (P) Ltd., Behjoi, Moradabad in respect of the proceedings taken under Section 29 by the U.P. Financial Corporation under the State Financial Corporation Act. The petitioner along with others responded to the aforesaid advertisement in which the offer of Smt. Neeru Jain for an amount of Rs. 4,65,000/- was accepted. The records also reveal that the amount offered by the petitioner was only Rs. 4,50,000/- and that the petitioner had also been asked to attend the meeting of the Negotiation Committee in respect of his proposal for purchasing the assets of M/s. Ravindra Foam Products (P) Ltd., Behjoi, Moradabad. The sale deed was executed on 4th July, 2005. This writ petition has been filed after a lapse of about eight months for quashing the aforesaid sale deed and for execution of the sale deed in favour of the petitioner.
In view of the fact that the offer of the petitioner was lower than the offer of Smt. Neeru Jain, we see no good reason to entertain this petition particularly when it has been filed after a lapse of eight months from the execution of the sale deed.
The writ petition is, accordingly, dismissed.
