This petition has been filed for quashing the impugned order dated 12th September, 2005, passed by the Chancellor of the Choudhary Charan Singh University, Raj Bhawan, Lucknow, whereby the Chancellor has refused to grant affiliation to the petitioner institution for B.Ed. Course, for the Academic Session 2005-06.
A bare perusal of the order impugned indicates that reasons have not been assigned in the impugned order.
Learned counsel for respondent fairly stated that a fresh order in accordance with law shall be passed by the Chancellor of the University at the earliest.
In view of the aforesaid statement, we set aside the order dated 12th September 2005, passed by the learned Chancellor of the University, but we leave it open to the Chancellor of the University to pass a fresh reasoned order in accordance with law.
Learned counsel for the petitioner has raised an apprehension that any delay in the matter would seriously prejudice the petitioner institution, and therefore, the order may be passed at an early date. We have no reason to doubt that the learned Chancellor of the University shall expeditiously pass a fresh order in accordance with law, preferably, within a period of one month from the date a certified copy of this order is produced by the petitioner before the learned Chancellor.
In view of the above, the petition stands disposed of finally.
