HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Umeshwar Pandey, J.

Heard learned counsel for the petitioner.

On the application of petitioner for temporary injunction, the trial court has issued show cause notice and has fixed a date for the disposal. But in-stead of waiting for that date, the petitioner jumped in revision before the District Judge, which was obviously not maintainable in view of amended provisions of Section 115 C.P.C. Accordingly, that revision has also been dismissed. The petitioner has been impatient and has now jumped to this court in extra ordinary jurisdiction under Article 226 of the Constitution of India.

This petition is definitely not maintainable and is wholly misconceived. It is accordingly dismissed.
