Heard learned counsel for the applicants and learned A.G.A. and also perused the material on record.

The applicant is involved in case crime No. 51 of 2001, for the offence under Sections 396,307,364 I.P.C., Police Station Kayamganj, district Farrukhabad.

It is submitted that the entire F.I.R. is against unknown persons. The co-accused Kalloo Dheemar  and Ram Ladaite Dheemar have already been enlarged on bail by this Court. There are similar facts and allegations against the applicant and as such he is also entitled for bail on the ground of parity, which is though conceded  by the learned A.G.A. but bail is opposed.

In view of the entire facts and circumstances of the case, taking into  consideration some of the arguments advanced on behalf of the applicant in respect of the points discussed herein above and also ground of partial parity, without prejudice to the merits of the case, I find it to be a fit case for granting bail. Let the applicant be enlarged on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the concerned Court.
