1. The petitioner was a fair price shop licencee. This licence was cancelled on 27.10.2004. He filed an appeal, which was allowed on 27.4.2005 and the case was remanded for redecision on merits. The petitioner filed the present writ petition for a mandamus directing the respondents to supply him essential commodities.
2. We have heard counsel for the petitioner, standing counsel and Sri NK Pandey for the respondents. It is not disputed that the petitioner's licence thereafter has been cancelled on 13.6.2005. The petitioner has an alternative remedy by means of filing appeal against this order. The writ petition is dismissed on the ground of alternative remedy. The petitioner will have liberty to file an application under section 5 of the Limitation Act for condonation of delay. With these observations, the writ petition is dismissed.
