Summon the record within four weeks.
We have heard learned counsel for the appellants and learned A.G.A. and perused the record.
It is urged on behalf of the appellants that all the four appellants were armed with lathies and they are said to have assaulted the deceased and three others who sustained injuries in the course of incident. Co-accused Ramesh was alleged to have used iron rod in the course of incident. No specific role has been assigned to any of the appellants. He has also stated that all the four appellants were on bail during trial.
During pendency of appeal, let appellants-Sarju Prasad Maurya, Sant Ram Maurya, Rakesh and Rajesh be released on bail on their executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., Basti in S.T. No. 259/01 State Vs. Sant Ram Maurya and others, under Sections 147, 302/149, 323, 504 I.P.C., P.S. Sonha, District Basti provided the entire fine is deposited by each of the appellants within a period of one month from today.
The Chief Judicial Magistrate will send photocopies of the bail bonds to the Court immediately.
