Supplementary affidavit has been filed today which may be placed on record.
Sri Manu Khare and Sri Ajay Shankar have accepted notice on behalf of respondent no.1 and learned Standing Counsel for respondent nos. 2 and 3. They pray for and are granted three weeks' time to file counter affidavit. The petitioners shall have two weeks thereafter to file rejoinder affidavit. List immediately thereafter.
If the petitioners reinstate the respondent no.1 in service and pay his current salary as well as deposit half of the back wages, as directed by the Presiding Officer, Central Government Industrial Tribunal-Cum-Labour Court, Kanpur, the realization of the remaining amount shall remain stayed. However, it shall be open to the petitioners either to take work from the respondent no.1 or not, but he shall be paid his current salary. In case of default, the stay order shall stand automatically vacated.
