Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the allegation against the applicant is that he was taking the petrol fro the petrol pump of the first informant, but he was not paying the price of the petrol. He has misappropriated a sum of Rs. 12,000/-.
It is opposed by the learned A.G.A. by submitting that the applicant is having criminal antecedents.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Gajraj Yadav involved in Case Crime No. 99 of 2005, under Sections 387 I.P.C., Police Station Ratj , District Hamirpur be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned with the condition that the applicant shall appear before the court of learned C.J.M., Hamirpur in the first week of each month, in default it shall be open for the learned C.J.M. concerned to cancel the bail granted to the applicant.
