On the grounds taken in the affidavit filed in support of the application the matter is restored to its original number and the case is heard on merit.
From the records we find that respondent no.5 i.e. Sri Ram Sewak has filed a writ petition in this Court being Writ Petition No. 5044 of 2004 in which he has obtained an interim order. In the said petition, the present petitioner was not impleaded as a party respondent as a result of which he has filed an application for impleadment which is still pending disposal, as has been stated by the learned counsel for the petitioner. In such circumstances, we decline to entertain this petition and leave it open to the petitioner to pursue his remedy in the aforesaid Writ Petition No. 5044 of 2004 filed by Sri Ram Sewak.
Subject to the observations made above, the writ petition is dismissed.
