Shri R.C. Singh counsel for the petitioner submits that a sirdari patta was granted in favour of the petitioner in the year 1977 and that in view of the provisions of Section 131-B of the U.P. Zamindari Abolition and Land Reforms Act the petitioner has become bhumidar with transferable rights by operation of law and the petitioner has filed a suit under Section 229-B of the U.P. Zamindari Abolition & Land Reforms Act for declaration of his title which is pending for one year. It is stated that all the parties in the suit have been served and are represented. He submits that looking into the nature of controversy not much time should be taken in deciding the suit but the respondents are adopting delaying tactics. Only prayer made is that a direction be given by this court to the Sub Divisional Officer Powayan, Shahjahanpur before whom the suit is pending to decide it within a time bound period.
Having heard counsel for the petitioner and the standing counsel in the fact and in the facts and circumstances, this writ petition is disposed of with the direction that the Sub Divisional Officer Powayan, Shahjahanpur shall dispose of the suit no. 18 of 2005 expeditiously and if possible within a period of one year from the date a certified coy of this order is filed before him. It is made clear that this court has not expressed any opinion upon the merits of the petitioner's case
