This writ petition has been filed raising the grievance that petitioner as well respondent no. 4 had applied for allotment of a Betel Shop in the Court Compound of District Judgeship, Varanasi. In the advertisement for allotment, it had been made clear that if any person has not cleared all outstanding dues for the previous period, he shall not be entitled to get the allotment. However, the respondent no. 4 had not cleared outstanding dues for the last year, even then he had been allotted the Betel Shop illegally and arbitrarily, debarring the petitioner for the said allotment.
The learned Standing Counsel appearing for respondent nos. 1, 2 and 3 has submitted that as the petitioner has already filed representation before the learned District Judge, Varanasi, it would be desirable that this Court may direct the learned District Judge to decide his representation considering all factual and legal submissions made.
In view of the submissions made by the learned counsel for the parties, we dispose of the writ petition requesting the learned District Judge, Varanasi, respondent no. 2, to consider the grievance of the petitioner expeditiously, preferably within a period of four weeks from the date a certified copy of this order, as well as a copy of the representation, is placed before him.
We have not addressed ourselves to the merit of the case. Any observation made herein shall not influence the learned District Judge while taking the decision in this regard.
