The arms licence of the petitioner was cancelled on account of pendency of certain criminal cases against him. The petitioner states that during the course of appellate proceedings, he pointed out to the appellate authority that he had been acquitted in one of the criminal proceedings relating to the charges against him under section 324 I.P.C. In the second set of proceedings arising out of case crime no. 203 of 1991 under section 302 I.P.C. too, the petitioner had been acquitted.
In view of the averments made by the petitioner on affidavit which are not denied by the learned A.G.A., I direct the appellate authority to reconsider the case of the petitioner. The appellate authority may do so within three months from the date of production of the a certified copy of this order.
The writ petition is disposed of as above. There shall be no order as to costs.
