We have heard learned counsel for the appellants, Sri Ravi Agarwal, learned counsel for complainant, learned A.G.A. also and perused the impugned judgment.
Out of three appellants, Moti and Bal Kishan @ Bali are said to have abused the deceased and instigated their co-accused Amar Singh @ Chhote to kill Ram Gopal and on their instigation, Amar Singh is said to have fired the fatal shot at Ram Gopal. The same shot caused injuries to Prem Singh also.
In view of the facts and circumstances of the case, during pendency of appeal, let appellants- Moti and Bal Kishan @ Bali be enlarged on bail on their executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., J.P. Nagar in S.T. No. 570/02, State Vs. Amar Singh @ Chhote and others provided each of the appellants deposits a sum of Rs. 5,000/- in the court concerned within a period of six weeks from today. The recovery of remaining amount of fine shall remain stayed till the disposal of appeal.
The prayer for bail of appellant no.3 Amar Singh shall be considered after receipt of the record.
