Shri M.C. Tiwari, learned counsel for the petitioner states that he has filed an application supported by the affidavit of Shri Sandeep R. Joglekar, Area Manager- Sales of the petitioner company stating that the parties have reached on out of Court settlement whereby the respondent has accepted the liability to pay the rest Rs.30 lacs only and that he has received back payment. In view of the MOU arrived at with the respondent company he does not wish to press the winding up petition.
The winding up petition is accordingly dismissed as not pressed.
