Nirdosh Kumar v. Regional Transport Officer, Agra And Others - WRIT - A No. 17727 of 2006 RD-AH 7046 (31 March 2006)
Hon. Dr. B.S. Chauhan, J.
Hon. Dilip Gupta, J.
Heard Sri A.R. Dube, learned counsel for the petitioner, learned Standing Counsel appearing for respondent Nos. 1,2 and 6 and Sri Samir Sharma, learned counsel appearing for respondent Nos. 3 to 5.
As per the provisions of the Motor Vehicles Act, 1988 (hereinafter referred to as the ''Act'), no person is permitted to ply the vehicles without obtaining the valid permit. Grievance of the petitioner is that UPSRTC has not obtained any permit on the route in question, on which it is plying the vehicles.
If it is so, we direct the respondent Nos.1 and 2 to check and not to permit either UPSRTC or any other person to ply the vehicles on the route, unless he has a valid permit issued under the Act.
With these observations, we dispose of the writ petition finally.
