This is an application for bail moved on behalf of the applicant Sarfraj involved in case Crime No. 152 of 2005 under sections 8/18 and 21/22 NDPS Act, Police station Chandosi, district Moradabad.
Heard learned counsel for the applicant and the learned AGA and have perused the record.
The applicant was arrested by the police on 5.2.2005 and on search of his person 3 ½ Kg. heroine and 800 grams opium was recovered from the bag which the applicant was holding in his hand. In chemical examination the sample of the contraband seized heroine and opium were found.
There are no public witnesses to the search and recovery. The applicant is in jail for more than one year. The quantity of opium recovered is less than the commercial quantity whereas the quantity of heroine is more than the commercial quantity. There are no criminal antecedents of the applicant. Taking into consideration the facts and circumstances, I consider it to be a fit case for grant of bail to the applicant.
Let the applicant Sarfraj involved in case Crime No. 152 of 2005 under sections 8/18 and 21/22 NDPS Act, Police station Chandosi, district Moradabad, be enlarged on bail on his furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
