Manna Singh v. State Of U.P. - CRIMINAL APPEAL No. 1803 of 2006 RD-AH 7333 (5 April 2006)
Hon'ble Mukteshwar Prasad J.
Hon'ble R.N.Misra, J.
Heard learned counsel for the appellant, and learned A.G.A. and perused the record.
It is contended that the appellant, as per the prosecution version, was armed with rifle but he did not use his weapon in causing the injuries to the deceased and his mother Bittan Devi. It was Cheddu Shukla who actually fired at the deceased and caused his death.
Considering the role-played by the appellant and material on record, we are inclined to release the appellant on bail. Let the appellant Manna Singh be released on bail in S.T.No. 436 of 1998 (State vs.Cheddu Shukla and others) on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the C.J.M. Fatehpur provided the appellant deposits the entire amount of fine within a period of one month from today.
The Chief Judicial Magistrate will send photocopies of the bail bonds to the Court immediately.
