During the course of argument, learned counsel for the petitioner has confined his argument to admitting the liability under the impugned order dated 26.11.2005, annexure-3 to this writ petition, but has sought to pay the said amount in instalments.
In the circumstances, after hearing learned counsel for the petitioner and the learned standing counsel, we dispose of this writ petition directing that the recovery of the amount mentioned in the order dated 26.11.2005 will not take place provided the petitioner deposits the entire amount mentioned there in four almost equal quarterly instalments, the first instalment to be paid on or before 31st May 2006.
It is made clear that any amount deposited towards the said liability will be adjusted while calculating the instalments.
