We have heard learned counsel for the appellants, learned A.G.A. and perused the impugned judgment.
It is contended that the case of the prosecution is based on circumstantial evidence and there is evidence of last seen only against the appellants. No other evidence was led against the appellants to connect with the crime.
During pendency of appeal, let the appellants-Raj Kumar @ Pappu and Phool Kumar @ Nanhey be enlarged on bail on their executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., Bareilly in S.T. No. 29/94, State Vs. Lala Ram and others provided the entire amount of fine is deposited by each of the appellants in the court below within a period of one month from today.
The Chief Judicial Magistrate will send photocopies of the bail bonds to the Court immediately.
