Heard learned counsel for the applicant, learned A.G.A. and perused the record.
According to the prosecution case there was a strange relationship in between Smt. Sagma Begum daughter of the brother of complainant and her husband co-accused Shamiuddin who were married some 13 years back. On 3.11.05 when the complainant and other member of his family came out from masque after offering the Namaz the accused persons 10 in numbers including the applicant armed with fire arm fired upon the complainant party causing injuries to the complainant and his family members. In all three members of the family of the complainant and one outsider received injuries. The injury report of Ashfaq @ Munna and Haji Mohammad show that the injuries are dangerous to life and on vital part of the body. The injuries of Munna Lal was also dangerous to life and on vital part of the body.
In the circumstances of the case I am of the opinion that the applicant does not deserve bail. The bail application is rejected.
