We have heard learned counsel for the appellants, learned A.G.A. and perused the impugned judgment.
It is urged that the appellants were named in the F.I.R. after recovery of the dead body and none actually saw the appellants committing murder of Mathura Prasad Bangali. P.W.2 Virendra Singh and P.W.3 Arjun were allegedly employees of the deceased and they did not disclose the names of the appellants to the complainant or member of his family in the night in question.
Considering all facts and circumstances of the case, during pendency of appeal, let the appellants-Munish Kumar @ Rajpal and Naresh be enlarged on bail on their executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., Mathura in S.T. No. 284/03, State Vs. Munish Kumar @ Rajpal and others.
The Chief Judicial Magistrate will send photocopies of the bail bonds to the Court immediately.
