This is an application for bail moved on behalf of the applicant Suresh Yadav involved in case Crime No.  165 of 2005 under section 306 I.P.C., Police station Tahbarpur, district Azamgarh.

Heard Sri P.C. Srivastava, learned counsel for the applicant and the learned AGA and have perused the record.

On June 13, 2005 the wife of the applicant committed suicide by jumping into the well along with her minor child. The minor child also died. The marriage has taken place about eleven years before. It is alleged that there has been a heated exchange between the applicant and his wife on the date of the occurrence followed by beating as a result of which she committed suicide.

The learned counsel for the applicant submitted that there is no demand of dowry. The marriage had taken place about eleven years before. The learned counsel pointing out the averments made in paragraph 8 of the counter affidavit submitted that the applicant's wife used to pressurize him to take her to Delhi where the applicant was working.

The marriage had taken place about eleven years before. There is no allegation of demand of dowry. It being a case of suicide, there is no allegation of demand of dowry, the applicant is entitled to bail.

Let the applicant Suresh Yadav involved in case Crime No.  165 of 2005 under section 306 I.P.C., Police station Tahbarpur, district Azamgarh, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
