This is an application for bail moved on behalf of the applicant Gopal Singh indicted in case Crime No. 189 of 2005 under section 41/102 Cr.P.C. and sections 411, 467, 468, 471 I.P.C., Police station Onchha district Mainpuri.

Heard Sri Onkar Nath, learned counsel for the applicant and the learned AGA and have perused the record.

Put briefly the prosecution story is that on August 13. 2005 at about 1.30 p.m. the applicant riding on Hero Honda Passion Black colour U.P. 82 F 4734 and the co-accused riding on another motorcycle were intercepted by the police. The applicant made a confession that the said motorcycle was stolen property. At the pointing out of co-accused recovery of two other motorcycles was made from his house. The motorcycle recovered from the possession of the applicant has not been connected with the theft. There are no public witnesses to the recovery. The applicant is in jail for the last about eight months. The offence is triable by the Magistrate Ist class. In view of these facts, I consider it to be a fit case for grant of bail.

Let the applicant Gopal Singh indicted in case Crime No. 189 of 2005 under section 41/102 Cr.P.C. and sections 411, 467, 468, 471 I.P.C., Police station Onchha district Mainpuri, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
