This is an application for bail moved on behalf of the applicant Laley alias Lala Ram involved in case Crime No. 169 of 2006 under section 307 I.P.C. and section 10/12 and 12/14 of Dacoity Affected Areas Act, Police station Roth, district Jhansi.

Heard Sri L. C. Mishra, learned counsel for the applicant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that the applicant has been acquitted in case Crime No. 203 of 1995 under section 302 I.P.C. and case Crime No. 86 of 1995 under sections 147, 148, 149 I.P.C., Police station Moth, district Jhansi, The learned counsel argued that it is a case of no injury.

The learned AGA submitted that  there is criminal history of the twelve cases of serious nature  against the applicant and in  case he is released on bail he will  indulge in commission  of other offences.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant is said to have opened fire at the police party but none of the police personnel sustained injuries. This being a case of no injury, I consider it to be a fit case for bail.

Let the applicant Laley alias Lala Ram involved in case Crime No. 169 of 2006 under section 307 I.P.C. and section 10/12 and 12/14 Dacoity Affected Areas Act, Police station Roth, district Jhansi, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and on giving an undertaking that he will appear before the investigating agency and the court as and when required.
