The petitioner's fair price shop has been suspended. No show cause has been given to the petitioner. The writ petition has been filed with the averment that the District Supply Officer does not have jurisdiction to pass the suspension order, as this jurisdiction lies with the Deputy Collector. The Standing Counsel has produced a copy of the Government Order dated 30.9.2004 by which the power has been delegated to the District Supply Officer also. Thus, the impugned order cannot be said to be without jurisdiction.

The petitioner has two options either to submit a reply to the show cause notice or to file an appeal against the suspension order. If the reply is submitted, the same will be considered by a reasoned order as expeditiously as possible.

Writ petition is disposed of as above.
