By means of this writ petition the petitioner has challenged the order dated 10.3.2006 passed by the Motor Accident Claims Tribunal directing recovery of the amount awarded in Motor Accident Claims Petition No. 10 of 1998.

Admittedly against the said award the petitioner has already filed F.A.F.O. No.(65) of 2003. Since the recovery is being made in pursuance of the said award passed in Motor Accident  Claims Petition, against which the aforementioned F.A.F.O. has already been filed, in my view this writ petition would not be maintainable.

Accordingly this writ petition is dismissed, however, with liberty to the petitioner to file an application in F.A.F.O. No.(65) of 2003 for grant of interim relief.
