Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that the applicants are Cleaner and Conductor of a truck by which one calf and bullocks were transporting. The applicants are having no concerned with the above mentioned bullocks and calf and only on the basis of the presumption it is alleged that the transportation was done for slaughtering purpose, but there was no such evidence. The applicants are in jail since 17.2.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and learned A.G.A. and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Babu Islam and Ajmeri involved in Case Crime No. 23 of 2006, under Sections 3/5/8 Cow Slaughter Act, under section 11 of Prevention of Cruelty to Animals Act under section 307 I.P.C. and 7 Criminal Law Amendment Act Police Station George Town , District Allahabad be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
