Heard learned counsel for the petitioner and perused the record.
By means of this writ petition, the petitioner has challenged the award dated 28.9.2005 passed by the Motor Accident Claims Tribunal whereby a sum of Rs. 5,000/- has been awarded against the petitioner and in favour of respondent no. 1 on the ground that respondent no. 1 had received injuries in an accident which had occurred because of the rash and negligent driving of the driver of the vehicle in question which is owned by the petitioner.
On perusal of the award I do not find any good ground for interference with the findings recorded nor the learned counsel for the petitioner has been able to point out any illegality with the same except for that the petitioner has been falsely implicated in the case on account of enmity. Such submission of the petitioner is not acceptable in view of the categorical findings of fact which have been recorded by the Tribunal which are all on the basis of the evidence adduced by the parties. As such, I do not find any good ground for interference with the order impugned in this writ petition.
This writ petition is, accordingly, dismissed. No order as to costs.
