This petition has been filed for a direction upon the respondents to pass an appropriate order for giving the desired papers/information relating to the personal details of his wife so that he can obtain the necessary succession certificate and submit the same before the authorities for payment of retiral dues.
The petitioner's wife died while in service on 7th January, 2005. The petitioner then made a request for payment of pension and other post retiral benefits but the Medical Officer, P.H.C., Azamgarh intimated the petitioner that the details given by him do not tally with the details disclosed in the service book of late Smt. Raji Devi. The petitioner, therefore, made a request to the Chief Medical Officer, Azamgarh for providing the necessary details and since nothing was heard he also sent a representation to the Commissioner, Azamgarh Division, Azamgarh for directing the Chief Medical Officer to provide the documents so that the payment of retiral benefits of late Smt. Raji Devi may be made to the petitioner.
Sri C.K.Rai, learned Standing Counsel has stated that the Chief Medical Officer, Azamgarh shall examine the matter and provide the necessary information to the petitioner in accordance with law provided the petitioner makes a detailed representation to the Chief Medical Officer within a period of two weeks.
In view of the aforesaid statement made by learned Standing Counsel, we dispose of the writ petition with a direction that in the event the petitioner files a detailed representation before the Chief Medical Officer, Azamgarh, the same shall be considered in accordance with law and appropriate orders shall be passed expeditiously preferably within a period of two weeks from the date of filing the representation.
