Standing counsel represents respondents 1, 2, 3 and 4. Gaon Sabha respondent no.5 is represented by Sri Anuj Kumar. His brief holder Sri S. K. Yadav prays for and is granted three weeks time to file a counter affidavit. The petitioner will have three days thereafter to file a rejoinder affidavit.

It is submitted by the petitioner's counsel that the petitioner was the highest bidder for the auction held on 17.1.2006 and had also deposited 25% of the bid amount but on an application made by the respondent no.6 behind the back of the petitioner after more than two months an order dated 24.3.2006 was passed for re-auction of the pond and within three days thereof the pond was given to the respondent no. 6 without opportunity to the petitioner to improve his bid, which he is ready to raise.
In view of the contention advanced until next date of listing parties shall maintain status quo.
