This is an application for bail moved on behalf of the applicant Bablu indicted in case crime No. 395 of 2006 under section 364 I.P.C. P.S. Baraut District Baghpat.
Heard Shri Praneet Kumar Srivastava, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the girl was carrying love affair with applicant's elder brother Sushil and she was recovered from the possession of co-accused Sushil. The learned counsel urged that the applicant has been falsely implicated being brother of co-accused Sushil. There is no previous criminal history of the applicant.
The learned A.G.A. submitted that the applicant and co-accused took away the girl from her residence in the dead hours of night at the point of country made pistol and kept her as hostage in the jungle and recovery was made from the custody of co-accused Suhsil.
I have taken into consideration the submissions advanced on behalf of both the parties.
The recovery of abducted girl having not been made from the possession of applicant, I consider it to be a fit case for bail.
Let the applicant Bablu indicted in case crime No. 395 of 2006 under section 364 I.P.C. P.S. Baraut District Baghpat , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
