This is a writ petition against order dated 22.3.2006 passed under section 14 (1) of the U.P. Co-operative Societies Act, 1965 directing the petitioner to make appropriate amendment in the objectives of the bye-laws of the petitioner-society.
We have heard counsel for the petitioner and the Standing Counsel for the respondents.
According to the petitioner, the amendment is not necessary and in any case this has been done without giving any opportunity to the petitioner.
In the circumstances of the case, the petitioner may file a fresh representation before respondent no. 2. In case the representation is filed, it may be decided by the respondent no. 2 by a reasoned order at an early date, if possible, within three months from the date of receipt of the representation. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self addressed envelope along with the representation. The concerned authority after taking decision will communicate the same to the petitioner. Needless to say that no further action will be taken without passing the orders on the representation of the petitioner.
With these observations the writ petition is disposed of.
