Heard Sri Murlidhar, learned senior counsel assisted by Sri C.B.Misra, learned counsel for the petitioner, Sri A.K.Sharma, learned counsel for the informant-respondent, learned AGA for the State and perused the record.
It has vehemently been argued by the learned counsel for the petitioner that if any case against the petitioner is made out, that can be said to be an accountancy and no criminal offence is constituted as alleged in the first information report. He further submits that the petitioner is always available to co-operate with the investigation and in no way tamper with the prosecution evidence, record etc., therefore, some protection be provided to him as the police machinery is raiding his house to effect his arrest in pursuance of the impugned first information report.
Considering the facts and circumstances of the case, learned AGA prays for and is granted ten days time to file counter affidavit.
The case shall appear on list on 02nd May 2006.
The investigation into the case in Case crime no. 60 of 2006 under Sections 419, , 468 IPC PS Civil Lines Distt. Allahabad shall go on but the investigating officer shall not effect the arrest of the petitioner till the date fixed, provided he co-operates with the investigation and in no way tamper with the prosecution evidence
