Shri Satyendra Kumar Singh holding brief of Shri Sankatha Rai very fairly states that respondent Nos.1, 2, 5 and 7 have since expired and that he has not filed any substitution application so far.

The appeal as such abates against respondent Nos.1, 2, 5 and 7 and since the suit was for mandatory injunction, the plaintiff appellant's appeal does not survive and abates as a whole.  The second appeal, as such, dismissed as having abated.
