Shri Manish Mehrotra, appearing in Company Petition No. 108 of 2000 on behalf of Shri P.C. Mehrotra-respondent and also heirs of J.C. Mehrotra in Company Petition No. 109 of 2000, informed the court that Shri P.C. Mehrotra had died in January 2006 and he does not know the name of his heirs.
The hearing of this matter cannot proceed in absence of heirs of P.C. Mehrotra as in most of these connected Company Petitions, the liability sought to be enforced is joint and severe for recovery of dues of the Bank from the hands of its ex directors under Section 45 (h) and 45 (l) of the Banking Regulation Act 1949 read with Section 543 of the Companies Act, 1956.
Much to the desire of the Court to hear and conclude the matter, the hearing has to be adjourned again to enable Shri Subodh Kumar, learned counsel for Union of India to bring on record the heirs of Shri P.C. Mehrotra and to revive Company Petition No. 108 of 2000 as well as Company Petition No. 109 of 2000.
Shri Manish Mehrotra may give name of the heirs of Shri P.C. Mehrotra and may like to appear in the matter on their behalf. The hearing is adjourned to 16.5.2006.
