Heard Sri Arvind Srivastava, learned counsel for the petitioner, learned A.G.A. and perused the record.
Supplementary affidavit filed today, be taken on record.
It is contended by the learned counsel for the petitioner that the petitioner is village Pradhan. He has not issued the A.P.L or B.P.L. cards for distribution of the food grains. Wrong facts have been mentioned in the F.I.R. as the Panchayat Secretary has issued a letter dated 11.4.2006, a copy of which is appended as annexure no. 1 to the supplementary affidavit that no such cards were issued to the petitioner.
Considering the facts and circumstances of the case, we direct that the investigation in Case Crime No. 1 of 2006 under Sections 419, 420, 504, 506v IPC, P.S. Chopan, District Sonbhadra shall go on and the same shall be concluded within a period of three months from the date of presentation of the certified copy of this order but the arrest of the petitioner shall not be effected till then, provided the petitioner cooperates with the investigation.
The writ petition stands disposed accordingly.
