Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the allegation against the applicant is that he demanded a sum of Rs. 2 lac from the first informant for providing possession of a land and threat was given that in case the aforesaid amount is not given the first informant and his son shall be murdered. It is said that this allegation is false and frivolous. The applicant has not demanded any money and no threat was extended by him. The applicant is in jail since 6.3.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Raju alias Shaeem involved in Case Crime No. 476 of 2006, under Section 386 I.P.C., Police Station C.B Nagar , District Bareilly be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
