Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. whereas co-accused Ramesh, Kailash and Prithvi Ram were named in the F.I.R. The name of the applicant was disclosed by the prosecutrix in her statement recorded under Section 164 Cr. P. C. The main accused Kailash Kumar has been released on bail by this court on 2.3.2006. There is no allegation in respect of rape. The applicant is also entitled to get the benefit of parity.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Ramesh involved in Case Crime No. 504 of 2005, under Sections 366 and 363 I.P.C., Police Station Ghatampur District Kanpur Dehat be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
