Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the allegation against the applicant that he had made an attempt to commit the rape is absolutely false because it is not supported by the medical evidence. The prosecutrix has not received any injury and her hymen was intact. The applicant was falsely implicated because there is dispute between him and the first informant. A suit is pending in the civil court between them.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Salman involved in case crime No. 13 of 2006, under Sections 376 and 511 I.P.C. Police Station Kotwali , District Meerutr be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
